Abstract– Although the Constitution guarantees the right of Mongolian citizens to own land, the lack of legal protections in other laws has led to the issuance of legal acts and regulations that fail
to ensure proper legal procedures. As a result, the legal framework to regulate this issue remains insufficient. This study aims to analyze and clarify these shortcomings. Also, this article conducts
constitutional restrictions in Mongolia, particularly regarding the availability of land resources for private ownership and the separate registration systems for land and immovable property. It
compares these aspects with foreign legal systems to identify key challenges citizens face in owning land today.
